It may seem obvious that problems will exist in the divorce process. After all, if there were no problems would the parties be getting a divorce to begin with? However, the existence of problems associated with divorce can be avoided or at least minimized.
People should first realize that the easiest way to avoid problems in the divorce process is to handle as many of the issues between yourself and your spouse. Understand that this may not always be possible; but if it can be done, your divorce will be a much less complicated event. Even if there are only a few points or issues you can agree upon, each issue you can put to rest between you and your spouse will save not only time and energy, but also money later in the process. While a variety of things can cause problems in the divorce process there are a number of issues that can present themselves that will be sure to cause problem – many times simply by appearing in a case.
Trust Issues This is perhaps the leading issue that causes problems in divorces. While it can many times be symptomatic of other, perhaps more serious issues, the trust, or lack thereof, can be the issue that people most often end up having to address. In a divorce, particularly one where the parties cannot agree, trust issues will likely be at the route of their disagreement. Be it a lack of trust over issues surrounding their children, their assets or debts, or their individual conduct, if one spouse refuses to trust the other, negotiations or other forms of agreements can be difficult.
In order to overcome trust issues, it is sometimes necessary to bring in the assistance of professionals such as counselors or divorce coaches. These individuals can help the party or parties work together to address the true root of the trust concerns and can help them better understand the entire process of divorce. By working on the root of these issues the parties can better move forward themselves.
While attorneys can and are a valuable part of the divorce process, they can sometimes manifest previously existing trust concerns.
Drug Issues
Drugs are one of most pervasive issues that can be encountered in a divorce. Their impact can be so overwhelming that there is often very little that can be done until the party using the drugs either admits their problem or until they receive the required treatment to help them with their drug problem.
In addition to the problems caused by the drugs themselves, other problems can arise as to safety issues, trust concerns or financial problems. Many times all that can be done is to start a contested case to protect the position of the non-drug using spouse and be supportive as the other spouse works through their problem. It will be imperative that the violence be addressed and that this issue not be allowed to continue unchecked if a fair and balanced result is desired.
Financial Issues Another leading cause of problems between married parties can often be related to financial concerns. Bills mount, tensions rise and other problems such as drugs or other substance abuse, trust concerns or even violence can be found. When such problems arise the parties may be best served by utilizing the services of a divorce financial planner or some other professional who has training and experience in working through the financial issues of a marriage. If there are financial issues or problems with money in a marriage, these issues will likely need to be addressed before the ultimate issues in the divorce can be resolved.
While these are but a few of the issues that can be encountered in a divorce, it is important that you realize when you are going through a divorce that other factors such as these can impact the ability of the parties to resolve a their divorce.
